DMCA / Copyright Policy

xNight.net ("the Website") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond expeditiously to claims of copyright infringement committed using the xNight.net website if such claims are reported to our Designated Copyright Agent.

1. Notification of Copyright Infringement

Upon receipt of a valid Notice, we will take whatever action, in our sole discretion, we deem appropriate, including the removal of the challenged content from the Website.

2. Required Information for DMCA Notice

To file a DMCA notice, you must provide the following information in writing:

3. Submitting Your DMCA Notice

4. Counter-Notice Procedures

If you believe that your material has been removed by mistake or misidentification, you may provide a written Counter-Notice to our Designated Agent. The Counter-Notice must include your physical or electronic signature, identification of the material removed, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, and your contact information along with a statement consenting to the jurisdiction of the federal court.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, xNight.net has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
